Traditional real estate brokerage assumed that all the brokers involved in a transaction were acting in the best interests of the Seller of the property. That is, they were agents of the Seller. When this was true, the agents owed the Seller specific duties to disclose information about the Buyer. This information may not have been in the Buyer's best interest.

How is Buyer Agency created?

Buyers have the right to hire a real estate broker as their agent as well. When Buyer Agency is created, the buyer becomes THE client, and the real estate broker can offer services they could not offer as a Seller's agent. Buyer Agency allows you to "hire" us as your agent throughout the process of finding your new home, determining its value, helping with financing terms, and consulting about negotiating strategies.

How is the Buyer's Agent paid? From the listing broker's (the Seller's Agent) marketing fee, commonly called the commission. It has already been set aside from the seller's proceeds as a term of the listing agreement. An aggressive listing broker uses that fee to accomplish the sale of the property by sharing it with any agent who brings a successful buyer into the transaction. In other words, the buyers agent is paid from the commission of the Listing Broker. It doesn't cost you, the buyer, a cent!
